These Terms and Conditions (“Agreement”) set forth the general terms and conditions governing your use of the Boiler Academy website (boileracademy.co.uk), a division of Gas Certify Ltd, and any of its related products and services (collectively, the “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Gas Certify Ltd (“we”, “us” or “our”), the owner and operator of Boiler Academy. If you are entering into this Agreement on behalf of a business or other legal entity, you confirm that you have the authority to bind that entity to this Agreement. In such cases, “User”, “you”, or “your” shall refer to the business or entity. If you do not have such authority, or if you do not agree with any part of this Agreement, you must not access or use the Website and Services. By accessing and using the Website and Services, including online training courses, subscriptions, member content, and the Learning Hub, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement. This Agreement constitutes a binding contract between you and Gas Certify Ltd, even though it is in electronic form and not physically signed by you.

If you create an account on the Boiler Academy website, you are solely responsible for maintaining the security of your login credentials and all activities that occur under your account. You are also responsible for ensuring that any information provided is accurate and kept up to date. We reserve the right—but are under no obligation—to review or verify new accounts before granting access to the Services. Submitting false, misleading, or incomplete contact details may result in the suspension or termination of your account without notice. You must notify us immediately at info@boileracademy.co.uk if you suspect any unauthorized use of your account or other security breaches. Gas Certfy Ltd is not liable for any loss or damage resulting from your failure to maintain the confidentiality of your login information or from any unauthorized activity conducted through your account. We may suspend, disable, or permanently delete your account if we determine that you have breached this Agreement or engaged in behavior that harms our platform, reputation, users, or business. In such cases, re-registration is prohibited, and we may block your email address and IP address to prevent further access. You must be at least 18 years old to register for and use the Boiler Academy Website and Services.

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Where Services are offered on a free trial basis, payment may be required after the free trial period ends and not when you enter your billing details (which may be required before the commencement of the free trial period). If auto-renewal is enabled for the Services you have subscribed for, you will be charged automatically in accordance with the term you selected. Sensitive and private data exchange happens over an SSL-secured communication channel and is encrypted and protected with digital signatures. The Website and Services also comply with PCI vulnerability standards to create as secure an environment as possible for Users. Scans for malware are performed on a regular basis for additional security and protection. If in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. In our sole discretion, we may limit or cancel quantities purchased per person, household, or order. These restrictions may include orders placed by or under the same customer account, credit card, and/or orders using the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided when the order was made.

You hereby irrevocably waive any claim against Gas Certify Ltd with respect to any damage, loss, or issue arising from your access to or use of third-party services, including their privacy policies, data practices, or security standards.

By choosing to enable or integrate any third-party service, you expressly grant Boiler Academy permission to share your data with those services to the extent necessary to facilitate the integration or functionality.

We are not responsible for the Content residing on the Website. We shall not be held liable for any loss of any Content. It is your sole responsibility to maintain an appropriate backup of your Content. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data you need will be available.

(f) to submit false or misleading information;

Gas Certify Ltd grants you a personal, worldwide, royalty-free, non-transferable, and non-exclusive license to use the digital tools, training software, and resources provided as part of the Boiler Academy Services. For the purposes of this Agreement, “Intellectual Property Rights” means all current and future rights granted by statute, common law, or equity in relation to copyright and related rights, trademarks, trade dress, service marks, designs, patents, inventions, database rights, domain names, goodwill, rights to sue for passing off, trade secrets, and all other intellectual property and proprietary rights—whether registered or unregistered—anywhere in the world, including all applications for and rights to apply for such protections.

This Agreement does not transfer any intellectual property rights from Gas Certfy Ltd or its licensors to you. All rights, titles, and interests in and to the Website, Services, and all associated content (excluding user-submitted content) remain solely with Gas Certfy Ltd, including those associated with the Boiler Academy name, logo, platform, course materials, and brand assets.

All trademarks, service marks, domain names, graphics, logos, and distinctive brand features displayed or used in connection with the Boiler Academy platform are either the property of Gas Certfy Ltd or are used with appropriate license or permission. Other trademarks, logos, or intellectual property rights referenced on the Website may belong to third parties and are used for identification purposes only.

Using the Boiler Academy Website and Services does not grant you any rights or licenses to reproduce, distribute, modify, or otherwise use any trademarks, proprietary information, or copyrighted content belonging to Gas Certfy Ltd or third parties, unless expressly authorized in writing.

The Services and content are protected by UK copyright law and other international intellectual property treaties. All rights not expressly granted in this Agreement are reserved.

Gas Certify Ltd, including its division Boiler Academy, shall not be liable for any loss of profits, revenue, data, goodwill, or other intangible losses—whether incurred directly or indirectly—arising from:

i) Your access to or use of, or inability to access or use, the Services

ii) Any conduct or content of any third party on the Services, including but not limited to defamatory, offensive, or unlawful conduct

iii) Any content, material, or information obtained through the Services

iv) Unauthorised access, use, or alteration of your transmissions or content

In no event shall Gas Certify Ltd, its directors, officers, employees, affiliates, agents, licensors, or suppliers be liable for any indirect, incidental, special, punitive, or consequential damages—including but not limited to loss of profits, revenue, sales, business interruption, anticipated savings, or loss of business opportunity—under any theory of liability, whether in contract, tort, negligence, warranty, or otherwise, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the total liability of Gas Certify Ltd and its affiliates for any claims relating to the Services will not exceed the amount paid by you (if any) during the one (1) month period prior to the event giving rise to such liability, or £1, whichever is greater.

These limitations and exclusions apply even if any remedy fails to provide adequate compensation or serve its essential purpose.

You agree to indemnify and hold Gas Certify Ltd, including its division Boiler Academy, and its affiliates, directors, officers, employees, agents, suppliers, and licensors harmless from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising from or relating to:

Any content you submit, post, or share through the Services

1- Your use or misuse of the Boiler Academy website and Services

2- Any violation of this Agreement or applicable law

3- Any negligent, unlawful, or improper conduct carried out through your account

This indemnity applies to any third-party claims, disputes, or demands resulting from your actions or content and remains in effect even after your use of the Services has ended.

All rights and restrictions contained in this Agreement shall apply only to the extent that they do not conflict with any applicable laws. It is the intention of both you and Gas Certify Ltd that this Agreement be interpreted and enforced in a manner that complies with all relevant legal requirements.

If any provision of this Agreement, or part thereof, is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remainder of this Agreement shall continue in full force and effect.

The invalidity of any one part shall not affect the enforceability of the remaining terms, which shall remain binding and enforceable as if the unenforceable portion had never been included.

This Agreement, including its formation, interpretation, and enforcement, shall be governed by and construed in accordance with the laws of England and Wales, without regard to any conflict of law principles.

You agree that any disputes, claims, or legal proceedings arising out of or relating to this Agreement, your use of the Boiler Academy Services, or your relationship with Gas Certify Ltd, shall be subject to the exclusive jurisdiction of the courts of London, England.

You hereby submit to the personal jurisdiction of those courts and waive any objection based on inconvenient forum or lack of jurisdiction. You also waive any right to a jury trial in connection with any legal action arising from or related to this Agreement.

The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.

Gas Certify Ltd reserves the right to update, modify, or amend this Agreement and any terms related to the use of the Boiler Academy website and Services at any time, at its sole discretion.

When changes are made, the "Last Updated" date at the bottom of this page will be revised. We may also notify you of material changes via email or other contact details you have provided, but are under no obligation to do so.

Unless stated otherwise, all changes will become effective immediately upon publication of the updated Agreement on the Boiler Academy website. Your continued use of the Website and Services after the effective date of any changes will constitute your acceptance of those revisions.

It is your responsibility to review this Agreement periodically to stay informed of any updates.

By accessing and using the Boiler Academy website and Services, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement.

If you do not accept or agree to comply with any part of this Agreement, you are not authorized to access or use the Website or any of the Services provided by Gas Certify Ltd.

Your continued use of the platform constitutes full acceptance of these Terms and Conditions.

You may terminate your legal agreement with Gas Certify Ltd at any time by deactivating your Boiler Academy account and discontinuing all use of the Services.

We reserve the right to suspend or terminate your access to the Website and Services, in whole or in part, at any time and without prior notice if we reasonably believe that:

i) You have violated this Agreement or any of our policies

ii) Your conduct creates risk or potential legal exposure for Gas Certify Ltd

iii) Your account is associated with unlawful or prohibited activity

iv) Your account has been inactive for a prolonged period

v) Continuing to provide Services to you is no longer commercially viable

Where possible, we will attempt to notify you using the email address associated with your account or upon your next login attempt, depending on the situation.

To the extent permitted by applicable law, Gas Certify Ltd may also suspend or terminate your account for any reason or no reason, at its sole discretion.

Upon termination of your access, all rights and licenses granted under this Agreement will immediately cease. However, the following sections of this Agreement shall continue to apply and remain in effect after termination:
